These Official Rules govern the National Society of High School Scholars Gift Card Giveaway (the "Sweepstakes") offered by ("Sponsor").
Sponsor: NSHSS, (“the Sponsor”), 1930 North Druid Hills Rd., Atlanta, GA 30319
Eligibility: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, Puerto Rico and the territory of Guam who are 18 years of age or older as of the date of entry and are contacted by Sponsor to participate in a survey that is deemed eligible for the Sweepstakes (‘Survey”), except employees of Sponsor and its affiliates, subsidiaries, advertising and promotion agencies and the immediate family members and/or those living in the same household of each such employee. Sweepstakes is void where prohibited by law.
Agreement to Rules: By participating, you agree to be fully bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree that all decisions of the Sponsor with respect to the Sweepstakes are final and binding.
Sweepstakes Period: Sweepstakes begins at 9am Eastern on April 18, 2020 and ends at 11:59pm Eastern on April 26, 2020 (the "Sweepstakes Period"). Sponsor shall determine timeliness of entries in its sole discretion.
How to Enter: Participate in a Survey conducted by NSHSS. All Survey responses are solely the property of NSHSS and may be used by or shared with third parties as needed, either individually or in the aggregate. No personally identifying information will be shared with any third party, except the winner’s name may be disclosed upon request as required by law.
You may also submit an entry by sending a 3′′ by 5′′ postcard to NSHSS, 1930 North Druid Hills Rd, Atlanta, GA 30319 ATTENTION: National Society of High School Scholars Gift Card Giveaway. On the postcard, write National Society of High School Scholars Gift Card Giveaway and include your name, address, date of birth, phone number and email address. Mail-in entries must be postmarked by April 26, 2020 and received by April 28, 2020 to be eligible to receive the prize.
Prize: Twenty (20) winners will receive a $50 gift card. Retail value of prize is $50. All fees, federal, state and other taxes, costs and expenses relating to the use, acceptance and possession of the prize are the sole responsibility of the winner.
Odds: Odds of winning will be determined by the number of eligible entries received. No prize substitutions are permitted.
Winner Selection and Notification: Twenty (20) winners will be selected in a random drawing from all eligible entries received, regardless of the content of the Survey response. All decisions of NSHSS are final. Potential winners will be notified by e-mail, telephone or U.S. mail. Winner must respond to accept the prize and sign and, if requested, return an affidavit of eligibility and a liability/publicity release within two weeks of notification. Sponsor shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information, or for any other reason. If the selected winner cannot be contacted, is ineligible, fails to claim the prize two weeks from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited, and an alternate winner selected. The winners names will be available from NSHSS at the address above upon request after August 5, 2020.
The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AT THE SOLE DISCRETION OF THE SPONSOR.
Release: As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsors, their affiliates, subsidiaries, retailers, sales representatives, distributors and the advertising and promotional agencies, and each of their officers, directors, employees and agents from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, taxes, and/or use or misuse of any prize, including without limitation, loss, damage, system damage, loss of property or data, accidents, injuries, or death, (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this sweepstake, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
General Conditions: Sponsor and each of its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; any error, omission, interruption, defect or delay in operation or transmission of any Sweepstakes-related website; failure of any entry to be received by Sponsor due to technical problems or human error; printing or other errors. Sponsor reserves the right to modify, suspend or terminate the Sweepstakes in the event that it becomes necessary due to circumstances beyond Sponsor's control. In the event the Sweepstakes is terminated early, a potential Winner will be selected from all eligible entries received at the time of termination.
Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE VIRGINIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the District of Columbia having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
Privacy: Information submitted with an entry is subject to the Privacy Policy at www.nshss.org.
